These Terms and Conditions ("Terms") govern your access to and use of the SaunaMap platform, website, and services (collectively, the "Platform") operated by SaunaMap ("SaunaMap," "we," "us," or "our"). By accessing or using the Platform as a guest, host, or visitor, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

These Terms apply to all users, including hosts who list sauna experiences and guests who book or inquire about them.

1. Acceptance of Terms

By creating an account, submitting a listing, making or inquiring about a booking, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Platform Role and Limitations

SaunaMap is a discovery and booking platform that connects individuals who offer sauna experiences ("Hosts") with individuals seeking sauna experiences ("Guests"). SaunaMap is not a party to any transaction, rental, or experience that takes place between Hosts and Guests.

SaunaMap does not own, operate, manage, inspect, or control any sauna facility listed on the Platform. We make no representations or warranties about the safety, quality, legality, or suitability of any listing or experience.

All transactions and arrangements made through or facilitated by the Platform are solely between the Host and the Guest. SaunaMap expressly disclaims any liability arising from such transactions.

3. Assumption of Risk

USE OF SAUNA FACILITIES AND RELATED WELLNESS EXPERIENCES INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO:

• Hyperthermia, heat exhaustion, heat stroke, or other heat-related illness or death
• Drowning or injury related to cold plunge, river, lake, or other water features
• Slip, fall, or physical injury on sauna premises
• Adverse health reactions related to heat, steam, or contrast therapy
• Allergic reactions or exposure to materials used in sauna construction or operation
• Any other physical, medical, or psychological harm

By using the Platform, both Hosts and Guests acknowledge and voluntarily assume all risks associated with sauna use and related activities. You agree that SaunaMap is not responsible for any injury, illness, death, or loss arising from your use of any sauna experience found on or booked through the Platform.

You are solely responsible for assessing your own physical fitness and health conditions before participating in any sauna experience. You are encouraged to consult a medical professional prior to use, particularly if you have cardiovascular conditions, respiratory conditions, pregnancy, or any other health concern.

4. Host Responsibilities

By listing a sauna experience on SaunaMap, Hosts agree to:

• Provide accurate, current, and complete information in their listing
• Maintain their sauna facility in a safe, clean, and functional condition
• Comply with all applicable local, state, and federal laws, regulations, permits, and health codes
• Carry adequate liability insurance for their sauna facility and operations
• Communicate clearly with Guests regarding access, rules, and expectations
• Treat Guests with respect and in accordance with applicable anti-discrimination laws
• Not collect, misuse, or disclose Guests' personal information beyond what is necessary to facilitate the booking

Hosts are solely responsible for the safety of their premises and the experiences they offer. SaunaMap does not inspect, verify, or guarantee the safety or accuracy of any listing.

5. Guest Responsibilities

By using the Platform to discover, book, or participate in a sauna experience, Guests agree to:

• Provide accurate and truthful information when making inquiries or bookings
• Follow all rules, guidelines, and instructions provided by the Host
• Treat Host property and facilities with care and respect
• Not engage in illegal, harmful, or disruptive behavior on Host premises
• Comply with applicable laws during their visit
• Not share, resell, or transfer bookings without Host consent

Guests acknowledge that they participate in sauna experiences at their own risk.

6. Code of Conduct

All users of the Platform, whether Hosts or Guests, agree to conduct themselves in a lawful, respectful, and appropriate manner at all times. This includes but is not limited to:

• Refraining from harassment, discrimination, or abusive behavior toward any other user
• Not using the Platform for any unlawful purpose
• Not misrepresenting your identity or the nature of your listing or booking
• Not engaging in any activity that damages, disrupts, or interferes with the Platform

SaunaMap reserves the right to suspend or terminate accounts that violate this Code of Conduct, at our sole discretion and without prior notice.

7. Privacy and Personal Information

Users agree not to collect, store, or use any personal information of other users obtained through the Platform for any purpose other than facilitating the specific booking or transaction for which it was shared. Misuse of personal information, including contact details, images, or location data, is strictly prohibited and may result in account termination and legal action.

Nothing in these Terms limits the rights of any individual under applicable privacy laws.

8. Preservation of Legal Rights

Nothing in these Terms is intended to limit, waive, or impair any fundamental rights or legal protections afforded to users under applicable law. Users retain all rights provided by consumer protection laws, civil rights laws, and other applicable statutes. These Terms do not prevent either party from pursuing legal remedies available to them under law.

9. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SaunaMap and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Platform
• Your listing, booking, or participation in any sauna experience
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any injury, illness, death, or property damage occurring in connection with a sauna experience you listed or attended
• Any dispute between you and another user of the Platform

SaunaMap reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with SaunaMap in asserting any available defenses.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SAFETY OF ANY SAUNA EXPERIENCE. SAUNAMAP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAUNAMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF REVENUE, LOSS OF DATA, OR ANY OTHER LOSS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY SAUNA EXPERIENCE, EVEN IF SAUNAMAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SAUNAMAP'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SAUNAMAP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Washington. This does not prevent either party from seeking injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against SaunaMap.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

14. Modifications to Terms

SaunaMap reserves the right to modify these Terms at any time. We will provide notice of material changes via email or prominent notice on the Platform. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SaunaMap with respect to the Platform and supersede all prior agreements and understandings.

SaunaMap ("we," "us," or "our") operates the website located at saunamap.com (the "Site"). This Privacy Policy describes how we collect, use, and protect information submitted through our Site by hosts, guests, and visitors.

By using SaunaMap, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Site.

Information submitted to SaunaMap is used to:

• Build, display, and maintain the SaunaMap directory and map
• Power listing pages visible to guests searching for saunas
• Facilitate communication between hosts and guests
• Send transactional emails related to bookings and account activity

Images and listing text submitted by hosts may be used in SaunaMap marketing materials, newsletters, and social media, in accordance with the license granted in our Terms and Conditions.

3. What We Do Not Disclose

We do not sell, rent, or trade your personal information to third parties. Specifically, we do not publicly disclose:

• Your full name (only a first name or host name may appear on listings, at your discretion)
• Your email address
• Your phone number (unless you explicitly opt in to display it on your listing)
• Precise coordinates of home saunas (coordinates are intentionally blurred for private residential listings)

We may share information with trusted service providers who assist in operating the Site (such as email delivery, cloud hosting, and payment processing), subject to confidentiality obligations.

4. Marketing Communications

By creating an account or submitting a listing on SaunaMap, you consent to receive marketing emails from us, including newsletters, promotional updates, and campaign communications.

You may opt out of a specific marketing campaign by clicking the unsubscribe link included in that communication. However, opting out of one campaign does not remove you from all future marketing communications.

To opt out of all marketing emails from SaunaMap, you must delete your account. You may request account deletion by contacting us at admin@saunamap.com.

You will continue to receive transactional and account-related emails (such as booking confirmations or security notifications) even after opting out of marketing, until your account is deleted.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide services. If you request account deletion, we will remove your personal information from active systems within 30 days, subject to any legal obligations requiring retention.

6. Cookies and Tracking

SaunaMap uses cookies and similar tracking technologies to improve your experience on the Site. You may control cookie settings through your browser, though disabling cookies may affect Site functionality.

The Site integrates with third-party services including Mapbox (for mapping), Supabase (for data storage), and email service providers. These services have their own privacy policies and we encourage you to review them.

9. Your Rights
