These Terms and Conditions ("Terms") govern your access to and use of the SaunaMap platform, website, and services (collectively, the "Platform") operated by SaunaMap ("SaunaMap," "we," "us," or "our"). By accessing or using the Platform as a guest, host, or visitor, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

These Terms apply to all users, including hosts who list sauna experiences and guests who book or inquire about them.

1. Acceptance of Terms

By creating an account, submitting a listing, making or inquiring about a booking, or otherwise using the Platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Platform on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Platform Role and Limitations

SaunaMap is a discovery and booking platform that connects individuals who offer sauna experiences ("Hosts") with individuals seeking sauna experiences ("Guests"). SaunaMap is not a party to any transaction, rental, or experience that takes place between Hosts and Guests.

SaunaMap does not own, operate, manage, inspect, or control any sauna facility listed on the Platform. We make no representations or warranties about the safety, quality, legality, or suitability of any listing or experience.

All transactions and arrangements made through or facilitated by the Platform are solely between the Host and the Guest. SaunaMap expressly disclaims any liability arising from such transactions.

3. Host-Supplied Terms and Conditions

SaunaMap may allow a Host to upload, post, or otherwise provide their own additional terms, rules, waivers, or conditions specific to their sauna listing ("Host Terms"). By booking, inquiring about, or otherwise engaging with a listing, Guests agree that, in addition to these Terms, they are also bound by any Host Terms the Host has chosen to provide for that listing. Guests are encouraged to review a listing's Host Terms, if any, before booking.

Host Terms are supplemental only. A Host's own terms may add rules or requirements specific to that sauna, but may not modify, limit, waive, override, or otherwise impact these Terms, the rights of SaunaMap, or SaunaMap's obligations (or lack thereof) in any way. If any provision of a Host's Terms conflicts with these Terms, these Terms control to the fullest extent of the conflict, and the conflicting provision of the Host Terms is void as between the Guest and SaunaMap.

Host Terms are drafted and provided solely by the Host, not SaunaMap. SaunaMap does not write, review, approve, endorse, verify, or guarantee the legality, accuracy, fairness, or enforceability of any Host Terms and has no obligation to do so, though SaunaMap may remove or require revision of Host Terms, at its sole discretion, if they conflict with these Terms or applicable law. Hosts are solely responsible for ensuring their own Host Terms comply with all applicable laws.

Each Host acts independently and on their own behalf, and not as an employee, agent, partner, joint venturer, or representative of SaunaMap. Nothing in a Host's listing, Host Terms, or communications with a Guest shall be construed as a statement, representation, or commitment made by or on behalf of SaunaMap. SaunaMap does not represent, and has no duty to defend, indemnify, or otherwise stand behind, any Host in connection with the Host's own Terms, conduct, or any dispute arising between a Host and a Guest.

Any dispute regarding the interpretation or enforcement of a Host's own Terms is solely between the Host and the Guest. SaunaMap is not a party to, and assumes no liability arising from, a Host's Terms or any dispute related to them. If a Host does not provide Host Terms for a listing, these Terms alone govern the booking.

4. Content License

By submitting photographs, descriptions, sauna information, or any other content to the Platform ("Content"), you grant SaunaMap a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, edit, publish, distribute, and display that Content for any purpose, including but not limited to:

• Marketing and promoting SaunaMap as a company
• Marketing and promoting the specific sauna listing to which the Content relates
• Any other business, editorial, or promotional purpose SaunaMap determines appropriate, in any media now known or later developed

This license survives removal of your listing or termination of your account with respect to Content already used or published. You represent that you own or otherwise control all rights to the Content you submit and that your Content does not infringe or violate the rights of any third party.

5. Assumption of Risk

USE OF SAUNA FACILITIES AND RELATED WELLNESS EXPERIENCES INVOLVES INHERENT AND SIGNIFICANT RISKS. THESE RISKS EXIST REGARDLESS OF YOUR AGE, HEALTH, OR FITNESS LEVEL AND INCLUDE, WITHOUT LIMITATION:

• Heat-related risks: Hyperthermia, heat exhaustion, heat stroke, dehydration, fainting, heart attack, cardiac arrest, or death — even in individuals who are otherwise healthy.
• Burns: Skin, respiratory, or other burns from contact with hot surfaces, steam, water, or sauna heating elements.
• Water and slip hazards: Wet and slippery surfaces in and around saunas, showers, cold plunges, rivers, lakes, or other water features, which can cause slipping, falling, drowning, or other serious injury or death.
• Hygiene and infection risks: Bacterial, viral, or fungal exposure from shared or communal facilities, surfaces, water, or other users.
• Personal exposure: Sauna use typically involves minimal clothing or undress. You will be in a state of partial or full undress and in close physical proximity to other people, which carries inherent risk of exposure.
• Conduct of other individuals: SaunaMap does not screen, supervise, or control Hosts, Guests, or any other person present at a sauna facility. SaunaMap is not responsible for the actions of any other person, including harassment, assault, or sexual assault committed by a Host, Guest, or third party. Any such act is the sole responsibility of the individual who committed it, not SaunaMap.
• Other risks: Allergic reactions, adverse reactions to heat, steam, or contrast therapy, and any other physical, medical, or psychological harm.

BY USING THE PLATFORM, CREATING AN ACCOUNT, LISTING A SAUNA, OR BOOKING A SAUNA EXPERIENCE, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTAND THE RISKS LISTED ABOVE, THAT THESE RISKS ARE OBVIOUS AND INHERENT TO SAUNA USE, AND THAT YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL SUCH RISKS. YOU RELEASE, WAIVE, AND DISCHARGE SAUNAMAP FROM ANY AND ALL LIABILITY, CLAIMS, OR CAUSES OF ACTION ARISING FROM THESE RISKS, AND YOU AGREE TO INDEMNIFY SAUNAMAP AS SET FORTH IN SECTION 11 BELOW.

You are solely responsible for assessing your own physical fitness and health conditions before participating in any sauna experience. You are encouraged to consult a medical professional prior to use, particularly if you have cardiovascular conditions, respiratory conditions, pregnancy, or any other health concern.

6. Host Responsibilities

By listing a sauna experience on SaunaMap, Hosts agree to:

• Provide accurate, current, and complete information in their listing
• Maintain their sauna facility in a safe, clean, and functional condition
• Comply with all applicable local, state, and federal laws, regulations, permits, and health codes
• Carry adequate liability insurance for their sauna facility and operations
• Communicate clearly with Guests regarding access, rules, and expectations
• Treat Guests with respect and in accordance with applicable anti-discrimination laws
• Not collect, misuse, or disclose Guests' personal information beyond what is necessary to facilitate the booking

Hosts are solely responsible for the safety of their premises and the experiences they offer, and for any Host Terms they choose to provide, as described in Section 3. SaunaMap does not inspect, verify, or guarantee the safety or accuracy of any listing.

7. Guest Responsibilities

By using the Platform to discover, book, or participate in a sauna experience, Guests agree to:

• Provide accurate and truthful information when making inquiries or bookings
• Follow all rules, guidelines, and instructions provided by the Host, including any Host Terms
• Treat Host property and facilities with care and respect
• Not engage in illegal, harmful, or disruptive behavior on Host premises
• Comply with applicable laws during their visit
• Not share, resell, or transfer bookings without Host consent

Guests acknowledge that they participate in sauna experiences at their own risk.

8. Code of Conduct

All users of the Platform, whether Hosts or Guests, agree to conduct themselves in a lawful, respectful, and appropriate manner at all times. This includes but is not limited to:

• Refraining from harassment, discrimination, or abusive behavior toward any other user
• Not using the Platform for any unlawful purpose
• Not misrepresenting your identity or the nature of your listing or booking
• Not engaging in any activity that damages, disrupts, or interferes with the Platform

SaunaMap reserves the right to suspend or terminate accounts that violate this Code of Conduct, at our sole discretion and without prior notice.

9. Privacy and Personal Information

Users agree not to collect, store, or use any personal information of other users obtained through the Platform for any purpose other than facilitating the specific booking or transaction for which it was shared. Misuse of personal information, including contact details, images, or location data, is strictly prohibited and may result in account termination and legal action.

SaunaMap does not disclose your personal contact information to other users except as necessary to complete a confirmed booking, as described in our Privacy Policy. Your first name may be displayed publicly in connection with any review you submit.

Nothing in these Terms limits the rights of any individual under applicable privacy laws.

10. Preservation of Legal Rights

Nothing in these Terms is intended to limit, waive, or impair any fundamental rights or legal protections afforded to users under applicable law. Users retain all rights provided by consumer protection laws, civil rights laws, and other applicable statutes. These Terms do not prevent either party from pursuing legal remedies available to them under law.

11. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SaunaMap and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Platform
• Your listing, booking, or participation in any sauna experience
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any injury, illness, death, or property damage occurring in connection with a sauna experience you listed or attended, including but not limited to the risks described in Section 5 (Assumption of Risk)
• If you are a Host, any Host Terms you provide, including their content, legality, enforceability, or any conflict between your Host Terms and these Terms
• Any dispute between you and another user of the Platform

SaunaMap reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with SaunaMap in asserting any available defenses.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SAFETY OF ANY SAUNA EXPERIENCE. SAUNAMAP DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAUNAMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOSS OF REVENUE, LOSS OF DATA, OR ANY OTHER LOSS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY SAUNA EXPERIENCE, EVEN IF SAUNAMAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SAUNAMAP'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SAUNAMAP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Washington. This does not prevent either party from seeking injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against SaunaMap.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles.

16. Modifications to Terms

SaunaMap reserves the right to modify these Terms at any time. We will provide notice of material changes via email or prominent notice on the Platform. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SaunaMap with respect to the Platform and supersede all prior agreements and understandings.

SaunaMap ("we," "us," or "our") operates the website located at saunamap.com (the "Site"). This Privacy Policy describes how we collect, use, and protect information submitted through our Site by hosts, guests, and visitors.

By using SaunaMap, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Site.

We collect information you provide directly when you create a listing, book a sauna, or contact us. This may include:

• Email address
• Phone number
• Physical address of sauna location
• Geographic coordinates
• Photos and images
• Descriptive text and listing content
• Booking and availability preferences

We may also collect non-personal technical information such as browser type, IP address, and usage patterns through standard analytics tools.

2. How We Use Your Information

Information submitted to SaunaMap is used to:

• Build, display, and maintain the SaunaMap directory and map
• Power listing pages visible to guests searching for saunas
• Facilitate communication between hosts and guests
• Send transactional emails related to bookings and account activity
• Send marketing communications, including newsletters and promotional content (see Section 4)
• Improve the functionality and content of the Site

Photographs, descriptions, and other sauna information you submit may be used by SaunaMap for any purpose, including marketing SaunaMap as a company, marketing the specific sauna listing to which the content relates, and any other business or promotional purpose, in accordance with the content license granted in our Terms and Conditions.

3. What We Do Not Disclose

We do not sell, rent, or trade your personal information to third parties. We do not publicly disclose:

• Your full name (only a first name or host name may appear on listings, at your discretion)
• Your email address
• Your phone number (unless you explicitly opt in to display it on your listing)
• Precise coordinates of home saunas (coordinates are intentionally blurred for private residential listings)

Your first name is displayed publicly alongside any review you submit.

We do not share or disclose your personal information with other users of the Platform except as described in this section. Once a Guest books a sauna, SaunaMap will share the personal information reasonably necessary to complete that booking (such as name, contact information, and sauna address) between the Host and Guest involved in that specific booking. This information is not disclosed to any other user or to the public.

We may share information with trusted service providers who assist in operating the Site (such as email delivery, cloud hosting, and payment processing), subject to confidentiality obligations.

4. Marketing Communications

By creating an account or submitting a listing on SaunaMap, you consent to receive marketing emails from us, including newsletters, promotional updates, and campaign communications.

You may opt out of a specific marketing campaign by clicking the unsubscribe link included in that communication. However, opting out of one campaign does not remove you from all future marketing communications.

To opt out of all marketing emails from SaunaMap, you must delete your account. You may request account deletion by contacting us at admin@saunamap.com.

You will continue to receive transactional and account-related emails (such as booking confirmations or security notifications) even after opting out of marketing, until your account is deleted.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide services. If you request account deletion, we will remove your personal information from active systems within 30 days, subject to any legal obligations requiring retention. Content already used under the license described in Section 2 and in our Terms and Conditions (for example, in past marketing materials) may continue to exist in previously published or distributed materials.

6. Cookies and Tracking

SaunaMap uses cookies and similar tracking technologies to improve your experience on the Site. You may control cookie settings through your browser, though disabling cookies may affect Site functionality.

7. Third-Party Services

The Site integrates with third-party services including Mapbox (for mapping), Supabase (for data storage), and email service providers. These services have their own privacy policies and we encourage you to review them.

8. Children's Privacy

SaunaMap is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you believe we have inadvertently collected such information, please contact us immediately.

9. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, or delete your personal data. To exercise these rights, contact us at admin@saunamap.com. We will respond within 30 days.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes via email. Continued use of the Site after changes constitutes acceptance of the updated policy.
